Terms of Service

Effective April 2026

These Terms of Service govern your access to and use of madtide, including our website, the affiliate program, and the penny auction platform (collectively, the Services). By creating an account or using the Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract in your jurisdiction to use madtide. The Services are not available where prohibited by law. You are responsible for complying with all applicable local laws.

2. Accounts

You agree to provide accurate, current, and complete information at signup and to keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. One account per person; duplicate or fraudulent accounts may be suspended or terminated.

3. Founder Affiliate Program

Joining as a founder affiliate is free during the founder window. By participating, you agree to the separate Affiliate Policies & Procedures, which are incorporated into these Terms. Founder positioning (including your username and referral link) is granted on a first-come basis and remains assigned to your account so long as the account stays active and in good standing.

4. Penny Auctions & Bid Packs

  • Bid packs are digital goods. Each bid in an auction has a fixed cost and is consumed when placed, regardless of auction outcome.
  • Bid pack purchases are non-refundable except where required by law.
  • Auction results are determined by the platform’s server-authoritative engine. Winning an auction is not guaranteed.
  • References to discounts (including “up to 99% off MSRP”) describe maximum potential savings on winning auctions for select inventory, while supplies last. Most auctions do not reach the maximum discount.

5. Acceptable Use

You agree not to:

  • Use bots, scripts, or automation to place bids or generate referrals.
  • Misrepresent madtide, its compensation plan, or potential earnings.
  • Spam, mislead, or coerce people into signing up under your link.
  • Attempt to manipulate auctions, payouts, referral attribution, or platform metrics.
  • Violate any applicable law or third-party right in connection with the Services.

6. Intellectual Property

All madtide trademarks, logos, software, and content are owned by madtide or its licensors. You receive a limited, non-exclusive, revocable license to use them solely for the purpose of using and promoting the Services in accordance with these Terms and our marketing guidelines.

7. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied. madtide makes no guarantee of income, savings, or results of any kind. See our Income Disclosure for details.

8. Limitation of Liability

To the maximum extent permitted by law, madtide and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

9. Termination

We may suspend or terminate your account at any time for violation of these Terms, the Policies & Procedures, or for conduct that harms madtide, other users, or third parties. You may close your account at any time by contacting support.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
